SHIPPING PROTECTION TERMS & CONDITIONS
BUYBARBER.COM SHIPPING PROTECTION TERMS & CONDITIONS
Effective Date: May 20, 2026
These Shipping Protection Terms & Conditions (“Terms”) govern the optional Shipping Protection service offered by VGM Enterprises Inc., doing business as BuyBarber.com (“Company,” “we,” “our,” or “us”), located at 4700 Meadows Ln, Las Vegas, NV 89107.
By purchasing Shipping Protection during checkout, the customer (“Customer,” “you,” or “your”) acknowledges, understands, and agrees to the following Terms.
1. Nature of Shipping Protection
Shipping Protection is an optional customer service protection program offered by BuyBarber.com to provide limited assistance in qualifying cases where a package is lost or damaged while in transit.
Shipping Protection is not insurance.
VGM Enterprises Inc. is not an insurance company, insurance broker, insurance agent, or insurance provider, and Shipping Protection is not represented, sold, or intended to be insurance coverage of any kind.
Shipping Protection may be made available at checkout or in the shopping cart through a third-party app or widget, including Shipcheck. Shipcheck is used only as a technology tool to offer the Shipping Protection option. The Shipping Protection program is administered by BuyBarber.com as an in-house customer service program.
The Shipping Protection fee is displayed at checkout and is optional unless otherwise stated.
2. Scope of Protection
Shipping Protection may apply only to qualifying orders that:
- were purchased with Shipping Protection at checkout;
- were shipped using a carrier selected, arranged, or approved by the Company;
- were lost or damaged while in transit;
- are supported by sufficient documentation;
- comply with all deadlines and claim requirements stated in these Terms; and
- are approved by the Company after review.
Shipping Protection applies only while the package is in the possession or control of the shipping carrier and before proper delivery has been completed.
3. End of Protection Upon Proper Delivery
Shipping Protection ends once the shipping carrier confirms that the package was properly delivered to the shipping address provided by the Customer.
For purposes of these Terms, proper delivery may include, but is not limited to, carrier tracking showing delivery to:
- the shipping address provided at checkout;
- a mailbox, parcel locker, front desk, mailroom, reception area, leasing office, or concierge;
- a porch, doorway, gate, or other location commonly used by the carrier for delivery;
- any location supported by carrier delivery confirmation, delivery photo, GPS record, signature confirmation, or other proof of delivery.
If the carrier marks the package as delivered correctly, Shipping Protection does not cover theft, disappearance, loss, misplacement, or any issue occurring after delivery.
This includes, without limitation, porch piracy, third-party theft, building theft, mailroom theft, package removal by neighbors, family members, employees, building personnel, or any other person after delivery.
4. Lost Packages
A package may be considered for Shipping Protection as lost only if the carrier confirms, determines, or reasonably acknowledges that the package was lost while in transit.
A package is not considered lost under this program solely because the Customer states that they did not receive it.
Orders marked as properly delivered by the carrier are not eligible for lost package protection, unless the carrier later confirms that the delivery record was incorrect.
The Company may require the Customer to cooperate with the carrier investigation, including providing statements, claim forms, identification, affidavits, or any other documentation reasonably requested by the Company or carrier.
5. Damaged Packages
Shipping Protection may apply to products damaged during transit.
For damaged shipment claims, the Customer must provide clear evidence that the product was damaged before or during delivery and not after delivery.
Required documentation may include:
- photographs of the damaged product;
- photographs of the shipping box;
- photographs of all internal packaging materials;
- photographs of the shipping label;
- proof of delivery information;
- description of the damage;
- confirmation that all packaging and damaged items have been retained; and
- any additional documentation requested by the Company.
The Customer must keep the damaged product, shipping box, shipping label, and all packaging materials until the claim is fully resolved. Failure to keep these materials may result in denial of the claim.
Cosmetic damage to external packaging alone, without actual product damage, is not covered.
6. Claim Deadlines
All Shipping Protection claims must be submitted within the required claim period.
For damaged packages, the claim must be submitted within seventy-two (72) hours from the carrier’s documented delivery date and time.
For lost in-transit packages, the Customer must contact the Company within seven (7) calendar days after the last carrier tracking update or expected delivery date, whichever occurs later, unless the carrier’s claim rules require a different timeline.
Claims submitted after the applicable deadline may be denied.
The Company may deny any claim if the delay in reporting prevents the Company or carrier from properly investigating the shipment.
7. Carrier Claim Requirement
A formal claim may be required with the shipping carrier before Shipping Protection benefits are approved.
The Company may decide, in its sole discretion, whether the carrier claim will be filed by the Customer or by the Company.
The Customer agrees to cooperate fully with any carrier investigation. Failure to cooperate with the carrier or the Company may result in denial of the Shipping Protection claim.
Approval of any Shipping Protection claim may depend on the carrier’s tracking records, investigation results, claim determination, or other available evidence.
8. Available Remedies
If a Shipping Protection claim is approved, the remedy will be determined by the Company and may be provided in one or more of the following forms:
- replacement product;
- store credit;
- credit toward a future purchase; or
- another resolution selected by the Company.
Unless otherwise required by law, approved Shipping Protection claims do not entitle the Customer to:
- a cash refund;
- credit card refund;
- bank refund;
- reimbursement in currency;
- or any direct monetary payment.
Store credit has no cash value, is non-transferable, and may be subject to additional terms or expiration limits unless prohibited by law.
9. Exclusions
Shipping Protection does not cover, and the Company shall not be responsible under this program for:
- packages marked as properly delivered by the carrier;
- theft occurring after delivery;
- porch piracy;
- third-party theft after delivery;
- packages delivered to the address provided by the Customer;
- incorrect, incomplete, or undeliverable shipping addresses provided by the Customer;
- customer refusal of delivery;
- packages returned to sender due to Customer error;
- delays in transit;
- weather-related delays;
- carrier service interruptions;
- cosmetic packaging damage that does not affect the product;
- claims without sufficient documentation;
- claims submitted after the required deadline;
- damage occurring after delivery;
- misuse, abuse, mishandling, or improper storage after delivery;
- missing items from a package when the shipping box shows no evidence of transit damage or tampering;
- manufacturer defects;
- warranty issues;
- dissatisfaction with the product;
- international customs delays, inspections, seizures, duties, taxes, or confiscations;
- acts of God, natural disasters, civil unrest, strikes, government actions, or force majeure events;
- any loss not directly related to carrier-confirmed loss or damage during transit.
10. No Warranty Coverage
Shipping Protection is strictly limited to qualifying loss or damage occurring during transit.
Shipping Protection is not a product warranty, extended warranty, guarantee, service contract, repair plan, or manufacturer protection plan.
Shipping Protection may not be used for:
- manufacturer defects;
- product malfunctions;
- performance issues;
- normal wear and tear;
- misuse;
- abuse;
- improper maintenance;
- dissatisfaction with the product;
- warranty replacement requests;
- missing accessories not related to carrier damage;
- or any issue unrelated to shipping loss or shipping damage during transit.
Any warranty-related claims, product defects, or product performance concerns must be handled exclusively through the applicable warranty procedures described in the Company’s Terms of Service, return policy, and/or manufacturer warranty documentation.
Shipping Protection and product warranty coverage are separate and independent programs subject to different terms, conditions, limitations, and claim procedures.
The Company reserves the right to deny any Shipping Protection claim that it determines to be warranty-related rather than shipping-related.
11. Orders Without Shipping Protection
If the Customer declines or does not purchase Shipping Protection at checkout, the order will not be eligible for benefits under this Shipping Protection program.
In such cases, BuyBarber.com will not be obligated under this program to replace, credit, or otherwise compensate the Customer for lost, stolen, delayed, or damaged packages, except where required by applicable law or expressly provided under another written Company policy.
Customers who decline Shipping Protection may still be subject to the standard claim rules, limitations, and liability terms of the applicable shipping carrier.
12. Customer Responsibilities
The Customer is responsible for:
- providing a complete and accurate shipping address at checkout;
- ensuring that the delivery location is secure;
- monitoring tracking information;
- promptly reporting any shipping issue;
- preserving damaged items and packaging;
- providing all requested documentation;
- cooperating with carrier investigations;
- complying with all deadlines stated in these Terms.
Failure to meet these responsibilities may result in denial of the claim.
13. Company Review and Discretion
The Company reserves the right to investigate any Shipping Protection claim and request additional information before making a decision.
The Company may approve, deny, limit, or modify a claim resolution based on:
- carrier tracking records;
- delivery confirmation;
- delivery photos;
- GPS data;
- signature records;
- package weight records;
- Customer documentation;
- prior claim history;
- suspected fraud or abuse;
- carrier investigation results;
- compliance with these Terms.
The Company’s determination regarding eligibility, approval, denial, or resolution of a Shipping Protection claim shall be final, subject to applicable law.
The Company may modify, suspend, or discontinue the Shipping Protection program at any time, provided that claims for prior eligible purchases will be reviewed under the Terms in effect at the time of purchase whenever reasonably possible.
14. Fraud, Abuse, and False Claims
The Company reserves the right to deny any claim that appears fraudulent, abusive, misleading, incomplete, inconsistent, or unsupported by the available evidence.
Submitting false information, altered photographs, misleading statements, fraudulent claims, or repeated suspicious claims may result in:
- denial of the claim;
- cancellation of Shipping Protection eligibility;
- cancellation of pending orders;
- refusal of future service;
- reporting to the carrier, payment processor, or appropriate authorities;
- any other remedy available to the Company under law.
15. Chargebacks and Payment Disputes
The Customer agrees to first allow the Company a reasonable opportunity to review and process any Shipping Protection claim through the Company’s internal claims process before initiating a chargeback, payment dispute, bank reversal, credit card dispute, or payment processor claim.
If a chargeback, payment dispute, bank reversal, or payment processor claim is initiated before the Shipping Protection claim process is completed, the Company may pause, suspend, or deny the Shipping Protection claim to avoid duplicate recovery or inconsistent claim outcomes.
Nothing in this section is intended to waive, limit, or restrict any non-waivable rights the Customer may have under applicable law.
The Company reserves the right to deny any pending or future Shipping Protection claim where a payment dispute has already resulted in a refund, reversal, credit, or other recovery connected to the same order.
16. Limitation of Liability
To the maximum extent permitted by applicable law, VGM Enterprises Inc., doing business as BuyBarber.com, shall not be liable under the Shipping Protection program for:
- indirect damages;
- incidental damages;
- consequential damages;
- special damages;
- punitive damages;
- emotional distress;
- lost profits;
- business interruption;
- loss of use;
- or any amount exceeding the original purchase price of the affected product.
Shipping Protection does not cover shipping delays, lost business income, missed appointments, lost clients, or other losses beyond the value of the qualifying affected product.
17. No Transfer
Shipping Protection applies only to the original Customer who purchased the protected order and may not be transferred, assigned, resold, or applied to any other order, customer, product, or transaction.
18. Mandatory Arbitration and Dispute Resolution
By purchasing Shipping Protection and/or placing an order with the Company, the Customer agrees that any dispute, claim, controversy, or cause of action arising out of or relating to:
- the Shipping Protection program;
- these Terms;
- any claim approval or denial;
- any alleged loss or damage;
- any order, shipment, transaction, or customer service matter;
shall be resolved exclusively through final and binding arbitration, except for matters that qualify for small claims court.
The arbitration shall be conducted in Clark County, Nevada, under the rules of the American Arbitration Association, or another arbitration provider selected by the Company where permitted by law.
The Customer knowingly and voluntarily waives:
- the right to a jury trial;
- the right to participate in a class action lawsuit;
- the right to participate in class arbitration;
- and the right to consolidate claims with other parties.
All arbitration proceedings shall be conducted on an individual basis only.
The arbitrator shall have authority to resolve disputes relating to the interpretation, applicability, enforceability, or formation of these Terms, including any claim that all or part of these Terms is void or voidable.
To the fullest extent permitted by law, the prevailing party in any arbitration or enforcement action may be entitled to recover reasonable attorneys’ fees and costs.
This arbitration provision shall survive the completion of the transaction, claim process, and any termination of the relationship between the parties.
19. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Nevada, without regard to conflict of law principles.
20. Severability
If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
Any invalid or unenforceable provision shall be interpreted, modified, or limited to the minimum extent necessary to make it enforceable where permitted by law.
21. Acceptance of Terms
By purchasing Shipping Protection during checkout, the Customer confirms that they:
- have read these Terms;
- understand these Terms;
- voluntarily agree to these Terms;
- understand that Shipping Protection is not insurance;
- understand that Shipping Protection does not cover theft or loss after proper carrier-confirmed delivery;
- understand that Shipping Protection does not replace product warranty coverage;
- and accept all limitations, exclusions, deadlines, and conditions stated herein.
