Business Identification

These Terms and Conditions ("Terms") govern your access to and use of BuyBarber.com (the

"Website"), operated by VGM Enterprises Inc., doing business as The Barber Company

("BuyBarber"). These Terms apply to all purchases made through our Website, retail store, repair

services, wholesale transactions, and any other products or services we provide.

By accessing our Website, creating an account, placing an order, or using any of our Services, you

acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy

Policy, Shipping Policy, and Returns, Refunds & Exchanges Policy.

1. Acceptance

By accessing or using BuyBarber.com, creating an account, placing an order, or purchasing any

products or services, you agree to be bound by these Terms and Conditions, together with our

incorporated herein by reference.

Customer Eligibility

By placing an order, you represent and warrant that you are at least eighteen (18) years of age or

the age of majority in your jurisdiction; you are legally authorized to enter into binding agreements;

all information you provide is accurate, current, and complete; and you are authorized to use the

payment method submitted with your order. BuyBarber reserves the right to refuse service or

cancel any order where this information cannot be reasonably verified.

2. Orders

All orders are subject to acceptance and availability. BuyBarber may refuse, limit, or cancel orders

suspected of fraud, pricing errors, or policy violations.

3. Pricing

Prices may change without notice. Obvious pricing errors may be corrected and affected orders

cancelled with a full refund.

Taxes

Applicable sales taxes will be calculated and collected where required by law. Customers are

responsible for any additional taxes, customs duties, import fees, brokerage fees, or other

governmental charges associated with their purchase, unless otherwise expressly stated by

BuyBarber.

4. Payments

Payment must be authorized before shipment. BuyBarber may verify billing information, identity, or

address before accepting an order.

Order Verification

To help protect our customers and prevent fraud, BuyBarber reserves the right to verify any order

prior to shipment. Verification may include confirmation of billing information, shipping address,

payment authorization, identity verification, telephone verification, or additional documentation

reasonably necessary to complete the transaction. Failure to provide requested information may

result in order delays or cancellation.

5. Fraud Prevention

BuyBarber reserves the right to investigate suspicious transactions, verify serial numbers, compare

warehouse records, review shipping documentation, inspect returned merchandise, request

photographs or other supporting documentation, and evaluate claims based on the totality of the

available evidence.

Customer Cooperation

Customers agree to reasonably cooperate with investigations relating to shipping claims, damaged

merchandise, incorrect shipments, warranty claims, return requests, payment disputes, or

suspected fraudulent activity. Requested documentation may include photographs, videos, shipping

labels, packaging, proof of purchase, serial numbers, or other information reasonably necessary to

evaluate the claim. Failure to reasonably cooperate may limit BuyBarber's ability to verify or resolve

a claim.

Refusal of Service

BuyBarber reserves the right to refuse service, restrict future purchases, suspend customer

accounts, cancel orders, or decline transactions when BuyBarber reasonably believes that fraud,

abuse, misuse of its policies, unlawful conduct, or repeated violations of these Terms have

occurred.

6. Shipping

Delivery estimates are not guaranteed. Risk of delay caused by carriers, weather, or events beyond

BuyBarber's reasonable control is not BuyBarber's responsibility.

Shipping Exceptions

Delivery dates are estimates only. Customers are responsible for providing accurate shipping

information. Additional shipping charges resulting from incorrect addresses, refused deliveries, or

returned packages may be the customer's responsibility. BuyBarber is not responsible for delays

caused by events beyond its reasonable control.

Export Compliance

Customers are responsible for complying with all applicable export, import, customs, and trade laws

governing the destination country. BuyBarber reserves the right to refuse, delay, or cancel

shipments where required by law or where export restrictions apply.

7. Returns

Returns are governed by BuyBarber's separate Returns, Refunds & Exchanges Policy,

incorporated into these Terms by reference.

Repairs & Replacement Parts

BuyBarber provides repair services and replacement parts for selected products. Repair completion

times are estimates only and may vary depending on parts availability, manufacturer delays, and

workload. Replacement parts and repairs may carry separate warranty terms.

8. Warranties

Unless otherwise stated, products are sold with the manufacturer's warranty only. To the maximum

extent permitted by law, all implied warranties are disclaimed where permitted.

Professional Use Products

Many products sold by BuyBarber are intended for professional or commercial use. Customers are

responsible for operating products safely and following manufacturer instructions.

9. Intellectual Property

All website content, images, graphics, logos, descriptions, and other materials are owned by

BuyBarber or their respective owners and may not be used without permission.

Reviews & User Content

Customers who submit reviews, photographs, videos, testimonials, or other content grant

BuyBarber a non-exclusive, worldwide, royalty-free license to display, reproduce, and use such

content for marketing and business purposes. Users agree not to submit false, defamatory,

misleading, unlawful, abusive, or infringing content.

10. User Conduct

Customers may not misuse the Website, submit false claims, abuse return policies, interfere with

operations, or engage in unlawful activity.

Electronic Communications

By using the Website or communicating electronically with BuyBarber, you consent to receive

communications electronically.

11. Chargebacks

Customers retain rights provided by applicable law to dispute transactions. BuyBarber reserves the

right to contest unsupported disputes and pursue remedies where fraudulent or deceptive conduct

is supported by evidence.

Evidence and Investigations

BuyBarber may consider shipping records, carrier documentation, warehouse records, packing

photographs, package weights, serial numbers, product inspections, customer documentation, and

communications when evaluating claims.

False or Fraudulent Claims

BuyBarber reserves the right to deny claims that are determined, after reasonable investigation, to

be false, misleading, unsupported by available evidence, or otherwise inconsistent with the facts.

Where permitted by applicable law, BuyBarber also reserves the right to pursue appropriate legal or

equitable remedies in cases involving fraud, theft, intentional misuse of its policies, or other

unlawful conduct.

12. Limitation of Liability

To the fullest extent permitted by law, BuyBarber is not liable for indirect, incidental, special,

consequential, or punitive damages arising from use of the Website or products.

Force Majeure

BuyBarber shall not be liable for delays or failures resulting from causes beyond its reasonable

control.

13. Governing Law

These Terms are governed by Nevada law. Exclusive venue shall be the state or federal courts

located in Clark County, Nevada, unless applicable law requires otherwise.

Attorneys' Fees

To the extent permitted by applicable law, the prevailing party in any legal action arising from these

Terms may recover reasonable attorneys' fees, court costs, and litigation expenses.

14. General Provisions

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in

effect. Failure to enforce any provision is not a waiver. These Terms, together with BuyBarber's

agreement. BuyBarber may update these Terms at any time by posting revised Terms on the

Website.

Website Availability

BuyBarber reserves the right to modify, suspend, discontinue, or update any portion of the Website,

products, pricing, services, promotions, or content at any time without prior notice. BuyBarber shall

not be liable for any modification, interruption, or discontinuation of the Website or any service

offered through it.

Product Availability

Product availability displayed on the Website is subject to change without notice. Inventory

quantities are estimates and may not always reflect real-time stock levels. BuyBarber reserves the

right to limit quantities, discontinue products, substitute packaging, or cancel orders when products

become unavailable.

Product Safety

Customers are responsible for reading and following all manufacturer instructions, warnings,

maintenance recommendations, and safety guidelines before using any product purchased from

BuyBarber. Improper use, modification, misuse, or failure to follow manufacturer instructions may

result in injury or damage for which BuyBarber assumes no responsibility to the fullest extent

permitted by applicable law.

Effective Date

These Terms and Conditions are effective as of July 1, 2026, and supersede all previous

versions published by BuyBarber.
